Terms of Service

Plain English. The basics of using our apps and this site.

/00The deal

By using software made by Dead Simple Technologies LLC ("we", "us") — including any of our apps and this website — you agree to these terms. If you don't agree, please don't use the software. That's the whole agreement.

/01Your license

When you buy or download one of our apps, we grant you a personal, non-exclusive, non-transferable license to use it on devices you own or control, for as long as the App Store you got it from continues to provide it.

/02Purchases

Our apps are sold through Apple's App Store and other marketplaces. Pricing, refunds, and billing are handled by those stores under their own terms. We don't process payments directly. If you need a refund, contact the store you purchased from.

"Pay once, own forever" means: no recurring subscriptions, no usage limits, no expiring features. It does not guarantee the app works on every future operating system forever — sometimes platforms change in ways we can't follow.

/03Acceptable use

Don't reverse-engineer, decompile, or redistribute the apps. Don't use them to break the law. Don't try to break things on purpose for other people. Otherwise, use them however you like.

/04Intellectual property

The apps, source code, logos, names ("Dead Simple", "Agoge"), and the skull-in-a-sombrero mark are ours. Your data — workouts, progress, settings — is yours. We don't claim any rights to it.

/05No warranty

The software is provided "as is", without warranty of any kind. We try to make things that work well, and we usually succeed, but we can't promise the app will be error-free or fit your specific purpose.

/06Limitation of liability

To the fullest extent allowed by law, Dead Simple Technologies LLC isn't liable for indirect, incidental, or consequential damages arising from use of the software. Our total liability for any claim is capped at what you paid us for the app, which is probably less than a sandwich.

/07Health & fitness disclaimer

Agoge is a tracking and progression tool, not a doctor. Calisthenics — like any exercise — carries risk. Consult a qualified professional before starting a new training program. Don't attempt skills you're not prepared for. Listen to your body. We're not responsible for injuries sustained from following progressions in the app.

/08Changes to these terms

We may update these terms occasionally. The updated date at the top reflects the current version. Continued use of the software after changes means you accept the new terms.

/09Governing law

These terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Disputes will be resolved in the state or federal courts located in Florida.
